This is an English-language summary of BICHIKU's Terms of Service, provided for convenience. The Japanese version is the governing document; if there is any discrepancy between the two, the Japanese version controls.
These Terms of Service (the "Terms") set out the conditions under which TRYANGROW (the "Company") provides the smartphone application "BICHIKU" (the "Service"). Users may use the Service only after agreeing to these Terms.
Article 1 (Application)
These Terms apply to all relationships between users and the Company in connection with use of the Service.
Article 2 (Registration)
- Anyone wishing to use the Service must agree to these Terms and apply for registration by the method the Company designates; registration is complete once the Company approves the application.
- The Company may decline a registration application where the applicant:
- has provided false information,
- has previously violated these Terms, or
- is otherwise deemed unsuitable by the Company for registration.
Article 3 (Fees and Payment)
- The Service offers a Free plan and a paid Premium plan.
- Under the Free plan, up to 50 stockpile items may be registered, and ads are displayed on screen.
- The Premium plan fee is $2.99/month or $19.00/year (or the local-currency equivalent shown in the App Store or Google Play), payable through the App Store or Google Play.
- The Premium plan includes a 7-day free trial. After the trial ends, it automatically converts to a paid subscription and the fee for the selected plan is charged.
- The Premium plan renews automatically unless cancelled. To cancel, use the settings in the App Store or Google Play before the next renewal date.
- Fees already paid are non-refundable, except as otherwise required by law.
- If you downgrade from Premium to Free, your existing stockpile data and family-sharing members are retained (not deleted), but new registrations and new invitations are limited according to the Free plan's caps.
Article 4 (Prohibited Conduct)
Users must not, in using the Service:
- violate any law or public order and morals;
- engage in conduct related to criminal activity;
- infringe the intellectual property rights, portrait rights, privacy, honor, or other rights or interests of the Company, other users, or third parties;
- place an excessive load on the Service's network or systems, or gain or attempt to gain unauthorized access;
- engage in conduct that could interfere with the operation of the Service;
- collect or store personal information about other users;
- use an invite code obtained through improper means to join another person's family-sharing group;
- falsify information provided by the Service;
- use the Service for an improper purpose;
- cause disadvantage, damage, or discomfort to other users or third parties;
- directly or indirectly provide benefits to antisocial forces; or
- engage in any other conduct the Company deems inappropriate.
Article 5 (Suspension of the Service)
The Company may suspend or discontinue all or part of the Service without prior notice to users where it determines that:
- maintenance, inspection, or updates of computer systems related to the Service are required;
- the Service cannot reasonably be provided due to force majeure such as earthquake, lightning, fire, power outage, or other natural disaster;
- a computer or communication line has stopped functioning due to an accident; or
- the Company otherwise determines that providing the Service has become difficult.
The Company bears no responsibility for any disadvantage or damage suffered by a user or third party as a result of such suspension or discontinuation.
Article 6 (Disclaimer)
Important notice about recommended stockpile amounts and earthquake notifications
The recommended stockpile amounts, achievement rates, and earthquake-linked notification feature displayed by the Service are reference information intended only to assist with your stockpile management. They do not guarantee your safety in an actual disaster.
- The recommended stockpile amounts provided by the Service are estimates calculated with reference to published government stockpiling guidelines, and do not guarantee sufficiency for every household or situation. Please make your own final determination of what to stock, also taking into account your local hazard maps and municipal disaster-preparedness information.
- The earthquake-linked notification feature operates based on information obtained from external earthquake-information providers, including unofficial private data sources. The Company makes no warranty as to the accuracy, completeness, or timeliness of this information. This feature is not a substitute for the Japan Meteorological Agency's official Earthquake Early Warning; in an emergency, always check official information first, such as from the Japan Meteorological Agency, your municipality's disaster-warning system, or television/radio broadcasts.
- Except where the Company has acted with intent or gross negligence, the Company bears no responsibility for damage arising from use of the Service, including but not limited to delayed, undelivered, or misdirected notifications, or discrepancies between the recommended stockpile amount and the amount actually needed.
- The Company makes no express or implied warranty that the Service is free of defects in fact or in law (including defects, errors, or bugs relating to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security, or any infringement of rights).
- Except where caused by the Company's intent or gross negligence, the Company bears no responsibility for any damage arising to a user from the Service. However, this disclaimer does not apply where the agreement between the Company and a user regarding the Service constitutes a consumer contract under Japan's Consumer Contract Act.
- Even in the case described in the proviso to the preceding paragraph, the Company bears no responsibility for damage arising from special circumstances, among damage caused to a user by the Company's default or tort due to its negligence (excluding gross negligence).
Article 7 (Changes to the Service)
The Company may change, add to, or discontinue the content of the Service upon prior notice to users, and users agree to accept such changes.
Article 8 (Changes to These Terms)
The Company may amend these Terms without prior notice to users where it deems necessary. If a user continues to use the Service after such an amendment, the user is deemed to have agreed to the amended Terms.
Article 9 (Handling of Personal Information)
The Company handles personal information obtained through use of the Service appropriately, in accordance with its separately published Privacy Policy.
Article 10 (Notices)
Notices or communications between a user and the Company are made by the method the Company designates.
Article 11 (Prohibition on Assignment)
Users may not assign or provide as security to a third party their position under the usage agreement, or any right or obligation under these Terms, without the Company's prior written consent.
Article 12 (Governing Law and Jurisdiction)
- These Terms are governed by and interpreted in accordance with the laws of Japan.
- Any dispute arising in connection with the Service is subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
